The Party Wall etc. Act 1996 is often referred to as “the Act”. The Act is a framework for preventing and resolving disputes in relation to boundary walls, Party walls and excavations close to neighbour’s buildings. The act was based on the London Building Acts, which applied to properties with in London for many years before the Party Wall etc. Act 1996. The legislation enables construction work close to boundaries across England and Wales where building owners intend to carry out work described in the Act. The Building owner known as the person wishing to undertake the works is obliged to give notice of their intention to their adjoining owner which is any party with an interest of more than a year in a property close to the works.

Our chartered surveyors Kent can negotiate with the other party on your behalf to agree the works and discuss the method and times the works are carried out to avoid any unnecessary inconvenience.  However, if there is no written agreement and we are brought in at a late stage we can use the act to provide dispute resolution.
